1. Parties
This Rental Agreement is entered into between the renter named on the booking confirmation ("Renter") and HiLucy ("Owner") for the rental of the vehicle identified in the booking.
2. Rental period
The rental period begins at the pickup time stated in the booking and ends at the return time stated in the booking. Late returns may incur additional charges at the prevailing daily rate, prorated to the nearest hour.
3. Authorized drivers
Only the Renter and additional drivers listed on the booking are authorized to operate the vehicle. All authorized drivers must hold a valid driver's license recognized in Mexico and meet the minimum age listed on the product page.
4. Use of the vehicle
The Renter agrees to use the vehicle only for lawful, personal use, and not to:
- operate the vehicle under the influence of alcohol or drugs;
- carry more passengers than the manufacturer's seating capacity;
- tow or push another vehicle;
- use the vehicle in racing, off-road events, or driver-instruction;
- transport hazardous, illegal, or commercial cargo;
- sub-rent the vehicle to a third party.
5. Insurance and liability
Basic damage protection is included in every rental and is summarized on the product page at the time of booking. The Renter remains responsible for damage caused by negligent or unauthorized use, and for any portion of a claim not covered by the included protection. Detailed terms are available on request.
6. Security deposit
A refundable security deposit is held on the Renter's payment method at pickup. The deposit is released when the vehicle is returned in the same condition it was rented in, less any documented damage or unpaid charges. Refunds typically post within 5–10 business days, subject to the issuing bank.
7. Fuel and operating costs
Unless otherwise stated on the booking, the Renter returns the vehicle with the same fuel level it was supplied with. Tolls, traffic citations, and parking fees incurred during the rental period are the Renter's responsibility.
8. Breakdown, accident, and incident reporting
The Renter agrees to notify HiLucy immediately by phone or messaging app of any accident, breakdown, theft, or police interaction involving the vehicle. Failure to report timely may void insurance coverage.
9. Cancellations and refunds
Cancellation terms are summarized on the product page at booking and at confirmation. Refunds, when due, post within 5–10 business days.
10. Governing law and venue
This Agreement is governed by the laws of Mexico and the State of Quintana Roo. Any dispute is subject to the jurisdiction of the courts of Tulum, Quintana Roo.
11. Acceptance
Submitting a booking and signing the rental agreement at pickup constitutes acceptance of this Agreement. The version of the Agreement accepted is recorded with the booking.
