HiLucy Terms of Service
1. Introduction and Acceptance
Welcome to HiLucy. These Terms of Service ("Terms") govern your access to and use of the HiLucy platform, including our AI-powered concierge service, property management tools, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Important: If you are using the Service as a guest at a property, certain terms may be supplemented by the property’s own policies.
2. Definitions
"Account" — Your registered account on the HiLucy platform.
"AI Concierge" or "Lucy" — Our AI-powered virtual assistant.
"Content" — Text, images, data, or other materials.
"Customer" — Property owners/managers who subscribe to HiLucy.
"Guest" — End users who interact with the Service at a property.
"Platform" — The HiLucy software, website, and services.
"Property" — Hotel, rental, or hospitality establishment using HiLucy.
"User" — Any person accessing the Service (Customers and Guests).
"We/Us/Our" — HiLucy and its affiliates.
3. Description of Service
HiLucy provides:
- AI Concierge: An AI-powered assistant for guest communications via WhatsApp and web chat
- Property Management Tools: Dashboards for managing guest requests, tasks, and bookings
- Integration Services: Connections to third-party systems (PMS, payment processors, etc.)
- Communication Tools: WhatsApp messaging, notifications, and staff coordination
We aim to provide reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time.
4. Account Registration
To create an Account, you must be at least 18 years old, have the legal capacity to enter into binding agreements, and provide accurate registration information. You are responsible for maintaining the confidentiality of your login credentials and all activities under your Account.
5. Subscriptions and Billing
Subscriptions are billed in advance on a monthly or annual basis via Stripe. Subscriptions automatically renew unless cancelled. We may change prices with 30 days’ notice.
6. Acceptable Use
You may use the Service to communicate with guests, manage property operations, and process legitimate service requests. You must NOT use the Service for illegal activities, transmit harmful content, attempt unauthorized access, manipulate the AI, or collect personal data without authorization. Violations may result in warning, suspension, or termination.
7. Intellectual Property
HiLucy owns or licenses all intellectual property in the Service. You retain ownership of Content you submit and grant us a license to use it to provide the Service. AI-generated content is for informational purposes and should be verified.
8. Data and Privacy
Our collection and use of personal data is governed by our Privacy Policy. Customers retain ownership of their guest data. Guests retain ownership of their personal information. Data export requests: [email protected].
9. Third-Party Services
The Service integrates with WhatsApp (Meta), Stripe, Cloudbeds, and Google services. Your use of these integrations is subject to their respective terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. The AI concierge may produce inaccurate responses and should not be relied upon for medical, legal, or emergency advice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Total liability shall not exceed fees paid in the 12 months preceding the claim or $100 USD.
12. Termination
You may terminate your Account by contacting [email protected]. We may suspend or terminate for violations, non-payment, or with 30 days’ notice. You may request a data export within 30 days of termination.
13. Dispute Resolution
Before filing a legal claim, contact [email protected]. These Terms are governed by the laws of Canada. Disputes are resolved individually.
14. Changes to Terms
We may modify these Terms with 30 days’ notice. Continued use constitutes acceptance.
